Getting a deportation lawyer to defend you is a must if you are going to have a real chance at winning in a deportation case. This is known as being in removal proceedings. Deportation is not easy to win. In fact under current immigration law, the odds of winning are stacked against you. In Los Angeles, there are thousands and thousands of immigration cases on the deportation docket.
The deportation lawyer knows what the Immigration Judge and the trial attorney are going to try to do to get you off their docket. He or she knows you are nervous and that you are afraid. However, there are multiple ways to properly represent a client in deportation proceedings. Technically, this is called ‘removal proceedings’ where the U.S. government tries to deport you.
Immigration Court is not there to be your friend, nor is the trial attorney on the other side of the court room. Having a deportation attorney represent you is in fact your best chance of success. In Los Angeles, you would have the deportation lawyer represent you at all the hearings including the master calendar hearing, the contested hearings and the merits hearing or the trial. The master calendar hearing only lasts for a few minutes and some people in deportation hearings think it is not important. On the contrary, the master calendar hearing is very important. It lays out the path for the deportation hearings for the remainder of the time you will be in front of the immigration judge. It determines what relief you will qualify for under immigration law. For example, in Los Angeles Immigration Courts, you will deny or admit to the allegations against you in the Notice to Appear and then that will determine if the Immigration Judge rules you are deportable. Afterwards, you would go to the contested hearing where by it would be the burden of the government to prove the allegations in the Notice to Appear that you denied.
The last thing you would want is a deportation order where you did not properly represent yourself. Be clear here. You are just a number on the docket to the Immigration Judge and the trial lawyer representing U.S. Immigration. There are thousands in front of you and thousands behind you and and the Immigration Court will never run out of cases. They would just prefer to give a deportation order and get you off the docket.
That is not quite the same if you are being represented by an Immigration Attorney. That deportation lawyer will in fact do his or her best to deny the allegations against you and/or to fight for relief you might be eligible such as adjustment of status, asylum or cancellation of removal.
Ultimately, while it is immigration law that determines what you qualify for under immigration law and U.S. Immigration, there are many gray areas which deportation lawyers will fight in order to try to win. The ultimate goal is to try to get the green card and that sometimes takes a few battles to win.
Deportation defense is exactly what is says. The deportation lawyer will defend you against being deported and/or being issued a deportation order. Make sure your deportation lawyer has years of experience, not just in immigration law, but in immigration court and in front of immigration judges.
